Terms of Service


By commissioning this artist, you are agreeing to the following Terms of Service. Failure to comply with the Terms of Service will get you blacklisted as a client.


General Guidelines

1) All commissions are for personal use only unless stated otherwise before work on the piece has been started, or a license has been negotiated in hindsight. Commercial licenses for both existing work as well as newly ordered work are available, and can be discussed up front or in hindsight. Prices fluctuate and can be adjusted to fit the budget of the client.1a) Commercial work is hereby defined as work that will be used to promote a person or brand, or generate a profit. This includes, among other things, the inclusion of the work on public youtube and streaming channels, the use of work for merchandising, or promotion on social media, and the use of work in publications that will in some way or other be distributed/monetized, like zines, advertisements, video games, or ttrpg manuals.1b) Exceptions to this rule or discounts on commercial licensing fees may be given in the case of small youtube channels or social media accounts with small audiences and budgets, but only after a mutual agreement has been made and consented to by both the commissioner and the artist.1c) The artist retains all rights that have not been expressly granted to Client in the case of commercial work.2) When posting commissioned work on social media or other platforms (regardless if there is a commercial purpose or not), it would be much appreciated to tag and credit the original artist, but this is not necessary if the work is posted with the watermark signature left intact. Under no circumstance shall the commissioner claim credit for the work themselves.3) Turnaround times are indications and can exceed the stated amount of time needed, or be done way faster than anticipated, depending on context.4) The artist retains all copyright of any images created during the commission process and may use them, among other things, for self-promotion.5) The commissioned work, whether commercial licensing has been purchased or not, is not to be used in campaigns or products that promote hate, incite violence, or are in any way against federal law- in the country of both the artist (the Netherlands), and the country in which the campaign/product is manufactured and/or distributed.6) The commissioned work can not be fundamentally altered and afterwards republished without the artist's knowledge and permission.7) Work commissioned from this artist can not be used by the commissioner to knowingly train AI text-to-image generators, be manually fed into other AI databases, or be used in NFT projects.


Commission Process

1) The commissioner can contact the artist via DM on any social media platform where the artist is active, or via e-mail, with their interest in a commission and a description of what they would want to order, including visual references for the artist to use. The artist and commissioner discuss and agree to a price and preferred way of contact. If an agreement is not reached, the transaction will end here and contact is ended.1a) The artist retains the right to refuse a commission for any reason without having to disclose this reason. If a payment has been made when the artist refuses further work on the commission, refer to the subsection " refunds" to see if a refund can be issued and how much of the original commission price shall be refunded.2) 100% of the payment shall be made up front by the commissioner to the artist through Paypal invoice. This invoice will be sent after the commissioner approves of the rough sketch that the artist will send them after receiving the order. The currency for these invoices is the Euro (€).3) After the commissioner has approved the rough sketch and the payment has been finalized, the artist will start work on rendering the end product, which will ultimately be delivered in .png format unless otherwise discussed up front. The artist will send in-progress shots while working through different phases of the work, preferably via e-mail. The amount of in-progress shots that a commissioner will receive varies, based on complexity of the order and number of revisions used.3a) There is a specified number of revisions included in the base price of different types of commissions. If the commissioner exceeds this amount, a fee will be added for each extra revision. The work will not be completed until these fees are paid. The revisions can be used up until a certain point during the work. This cut-off point for revisions depends on the type of commission, and can be found in the price list.4) When the work is done, the artist will send the commissioner different versions of the finished work: a fullsized version with signature, and a downsized version with signature (ideal for posting on social media). Both the artist and the commissioner are free to post the finished work on platforms of their choosing. The commissioner can choose to stay anonymous when the artist posts the commission to their social media.


Refunds

Payment needs to be paid up front and refunds are not normally offered once the artist has started to do work. In exceptional situations where the commissioner and artist agree to cancel the transaction and the work will no longer be completed, the following rules apply to refunds:- If the transaction is canceled before payment has been made, no further action will be taken.- If the transaction is canceled when payment has been made in full, but no work has started yet, the payment will be returned in full.- If the transaction is canceled when payment has been made in full and sketches (for character illustrations) / rough colors (for paintings) have been sent to the commissioner, 50% of the payment will be returned.- If the transaction is canceled when payment has been made in full and the artist has started rendering the final piece, no refund will be issued.- Refunds will only be supplied to the Paypal account that made the original payment.
